Terms of Use

These Terms of Use ("Terms") form a binding agreement between you and Cosmos Fantasy ("we," "our," or "us") and govern your use of the Cosmos Fantasy mobile application and website, together with all related features and services (the "Service").

Important: By creating an account or using the Service, you confirm that you have read, understood and accepted these Terms and our Privacy Policy. If you do not agree with them, please stop using the Service.

1. Who May Use the Service

You must be at least 13 years old to create an account. If you are under the age of majority in your country, you may only use the Service with the consent and supervision of a parent or legal guardian, who accepts these Terms on your behalf.

You may not use the Service if you have previously been removed from it, or if applicable law prohibits you from doing so.

2. Your Account

You must provide accurate information when registering and keep it up to date
You are responsible for keeping your password confidential and for all activity that takes place under your account
You may not sell, share or transfer your account to anyone else
You may not create multiple accounts to gain an unfair advantage in challenges, leaderboards or referral rewards
You must notify us immediately at contact@cosmos.xyz if you believe your account has been compromised

3. Acceptable Use

The Service includes public and private communication features. When you use them, you agree not to:

Harass, threaten, bully, stalk or intimidate any person
Post hate speech or content that attacks people based on race, ethnicity, national origin, religion, disability, gender, gender identity or sexual orientation
Post sexual, sexually suggestive, or violent content, or any content involving minors in a sexualised context
Impersonate another person, or misrepresent your affiliation with any person or organisation
Publish other people's private information without their consent
Send spam, chain messages, or unsolicited advertising
Upload malware, or attempt to gain unauthorised access to the Service, other accounts or our infrastructure
Use bots, scrapers or automated means to access the Service, or to inflate scores, coins, rankings or referrals
Exploit bugs or use any method to obtain coins or rewards other than the ones the Service intends
Infringe anyone's intellectual property rights
Use the Service for any unlawful purpose, or in a way that could damage or disable it

4. Your Content

4.1 Ownership

You keep ownership of the content you create and share on the Service, including posts, comments, messages, images and your profile information ("Your Content").

4.2 Licence you grant us

By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for display, and distribute it, solely for the purpose of operating, providing and improving the Service. This licence ends when you delete Your Content or your account, except where the content has been shared with others who have not deleted it, or where we must keep a copy to comply with a legal obligation.

4.3 Your responsibility

You are solely responsible for Your Content. You confirm that you have the rights needed to share it and that it does not violate these Terms or any applicable law.

5. Moderation, Reporting and Blocking

We want the community to stay usable and safe, so we provide the following tools and commitments:

Reporting: every message, post and comment can be reported from its context menu
Blocking: you can block any user, which hides their messages from you
Review: our moderation team reviews reported content and acts on violations, normally within 24 hours
Removal: we may remove content and suspend or terminate accounts that breach these Terms, with or without notice

We do not pre-screen all content. Content published by users does not represent our views, and we are not responsible for it. Safety concerns involving a minor should be sent directly to safety@cosmos.xyz. See also our Safety Guidelines.

6. Coins, Challenges and Rewards

The Service includes a virtual currency ("coins"), challenges, Treasure Quests, leaderboards and a referral programme.

            Coins have no monetary value. They are a limited, revocable licence to use a feature of the Service. They are not your property, they cannot be exchanged for real money or other value, they cannot be transferred or sold to other users, and they are not refundable. Cosmos Fantasy is not a gambling service: no real-money stake is placed and no cash prize is awarded.
        

We may change how coins are earned or spent, adjust reward amounts, correct balances that were credited in error, and cancel rewards obtained through cheating, abuse or exploitation of a bug. Coins are forfeited if your account is deleted or terminated.

Challenges, competitions and quests are governed by our Official Contest and Rewards Rules and by the specific entry conditions, closing dates, scoring criteria and rewards displayed in the app. Where a challenge determines a ranking, our verified calculation is final, except where applicable law requires otherwise.

7. Advertising

The Service is supported by advertising, including optional rewarded video ads that credit coins when you choose to watch them. Ads are delivered by Google AdMob. We do not control the content of third-party ads, and interacting with an ad is a relationship between you and the advertiser.

8. Premium Plans and Payments

Some features may be offered through a paid plan. Paid plans are sold and managed on our website and are processed by our payment provider, Stripe. Paid plans are not sold inside the iOS application.

Where you purchase a plan:

The price, billing period and included features are those displayed at the time of purchase
Subscriptions renew automatically for the same period unless you cancel before the end of the current period
You can cancel at any time; you keep access until the end of the period already paid for
Except where required by law, payments already made are non-refundable

We never receive or store your full card details. Payment data is handled by Stripe under its own terms.

9. Not Affiliated with the Premier League

Cosmos Fantasy is an independent companion application. It is not affiliated with, endorsed by, sponsored by, or associated with the Premier League, the official Fantasy Premier League game, or any football club. All club and competition names and marks belong to their respective owners and are used for identification only.

Statistics, fixtures and player data are provided for information purposes. We do not guarantee that they are complete, accurate or up to date, and you should not rely on them as your only source when making decisions in the official game.

10. Our Intellectual Property

The Service itself, including its software, design, interface, name and logo, belongs to us and is protected by intellectual property law. We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the Service for your own non-commercial use, in accordance with these Terms. You may not copy, modify, reverse engineer, decompile, resell or create derivative works from the Service, except to the extent that applicable law expressly permits it.

11. Third-Party Services

The Service relies on third-party providers, including Google Firebase (push notifications), Google AdMob (advertising) and Stripe (payments). Their use of data is described in our Privacy Policy and governed by their own terms. We are not responsible for third-party services or for websites you reach through links in the Service.

12. Suspension and Termination

You may stop using the Service at any time and delete your account from within the app, or at cosmos.xyz/account-deletion.

We may suspend or terminate your access, remove your content, or restrict specific features if you breach these Terms, if your behaviour harms other users or the Service, or if we are required to do so by law. Where it is reasonable and lawful to do so, we will tell you why.

On termination, your licence to use the Service ends immediately and any remaining coins are forfeited.

13. Changes to the Service and to These Terms

We are continuously developing the Service and may add, change or remove features. We may also update these Terms, for example to reflect new features or legal requirements. When a change is significant, we will notify you in the app, by email, or by updating the date at the top of this page before it takes effect. Continuing to use the Service after a change means you accept the updated Terms.

14. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranty that the Service will be uninterrupted, error-free, secure, or that any data or statistic it displays is accurate. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

15. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential or punitive damages, nor for loss of data, loss of profits, loss of coins or rewards, or damage resulting from content published by other users. Nothing in these Terms excludes liability that cannot legally be excluded, including liability for death or personal injury caused by negligence, or for fraud.

16. Indemnity

You agree to indemnify and hold us harmless against claims, damages and reasonable costs arising from Your Content, from your use of the Service in breach of these Terms, or from your violation of the rights of a third party.

17. Additional Terms for Applications Obtained from the Apple App Store

The following applies if you obtained the application from the Apple App Store, and prevails over any conflicting provision above in relation to Apple:

Parties. These Terms are concluded between you and us only, and not with Apple Inc. ("Apple"). Apple is not responsible for the application or its content.
Scope of licence. The licence granted to you is limited to a non-transferable licence to use the application on any Apple-branded product that you own or control, as permitted by the Usage Rules of the Apple Media Services Terms and Conditions.
Maintenance and support. We are solely responsible for providing maintenance and support for the application. Apple has no obligation to furnish any maintenance or support services.
Warranty. To the maximum extent permitted by applicable law, Apple has no warranty obligation with respect to the application. If the application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the application, if any. Apple has no other warranty obligation whatsoever.
Product claims. We, and not Apple, are responsible for addressing any claims relating to the application, including product liability claims, any claim that the application fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
Intellectual property claims. If a third party claims that the application infringes its intellectual property rights, we, and not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it against you.

18. General

If any provision of these Terms is found unenforceable, the remaining provisions stay in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a reorganisation or transfer of our business. These Terms, together with the Privacy Policy and the Safety Guidelines, form the entire agreement between us regarding the Service.
